1. Acceptance of Terms

By accessing or using Techsimum's service tracking software ("Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.

2. Description of Service

Techsimum provides a cloud-based service tracking software designed for technical service businesses. The Service includes features such as:

  • Device tracking and management
  • Customer notification systems (SMS, Email, WhatsApp)
  • Payment tracking and invoicing
  • Photo documentation
  • Reporting and analytics

3. User Accounts

To use our Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Upload malicious software or harmful content
  • Use the Service to send spam or unsolicited communications

5. Payment Terms

Subscription fees are billed annually in advance. All fees are non-refundable except as expressly stated in these Terms. We reserve the right to modify pricing with 30 days notice. Prices do not include VAT, which will be added where applicable.

6. Data Ownership

You retain all rights to your data. We do not claim ownership of any content you upload to the Service. You grant us a limited license to use your data solely for providing and improving the Service.

7. Service Availability

We strive to maintain 99.9% uptime. However, we do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Techsimum and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Techsimum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of termination. After this period, we may delete your data.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
